What is the ruling if a husband insisted to get sexual intercourse with his puerperium wife, and she was still in a state of birth blood discharge, but she did not want?
Answer
Praise Be to Allah and Peace Be Upon His Messenger.
Referring to your question, having sexual intercourse with a wife who is still in birth blood discharge or who is in her period is haram; this ruling is agreed upon by all scholars. She must reject; if the husband insists on doing that and she does as being enforced, she is not to be considered sinful; however, he is. The ruling is published on the Verdict House Webpage that all scholars agreed that having sexual intercourse in that situation is haram. Maimunah bint Al-Harith, one of the prophet wives narrated: “When the Messenger of Allah intended to associate and lie with any of his wives who was menstruating, he ordered her to wrap up the lower garment and then he had association with her.” Related by Al-Bukhari
Allah says: They ask you concerning menstruation. Say: that is an Atha (a harmful thing for a husband to have a sexual intercourse with his wife while she is having her menses), therefore keep away from women during menses and go not to them till they are purified (from menses and have taken a bath). And when they have purified themselves, then go in to them as Allah has ordained for you (go in to them in any manner as long as it is in their vagina). Truly, Allah loves those who turn to Him in repentance and loves those who purify themselves (by taking a bath and cleaning and washing thoroughly their private parts, bodies, for their prayers). Al-Baqarah: 222
If one committed the haram action, he has to repent, regret, and ask Allah to forgive him. It would be better if he pays a charity as the charity extinguishes bad deeds just as water extinguishes fire. He has to determine that he would not get to that haram deed ever.
