Why will the killer and the slain be in Hell? Is taking revenge from the killer a way to Hell?
Answer
Praise Be to Allah and Peace Be Upon His Messenger.
Abu Bakra Ath-Thaqafi narrated that Prophet Muhammad had said: “If two Muslims confront each other with their swords and one of them kills the other, both the killer and the slain will be in Hell.'" They said: "O Messenger of Allah, (we understand about) the killer, but what about the one who is killed?" He said: "He was eager to kill his opponent."
Thus, the slain is not considered an innocent; rather, he is eager to kill.
However, taking revenge should not be done individually; it should be controlled by the state so as to prevent any other murders; in addition, some times there would be mistakenly killing; thus, to prevet all these probable crimes, punishment should be implemented by courts and controlled by the state.
