What is the ruling on the one who does not want to give his sisters their portion from their father’s inheritance taking into consideration that the mother keeps ordering her daughters to waive their rights?
Answer
Praise Be to Allah and Peace Be Upon His Messenger.
This is an old fashioned tradition that is followed by most people even though they know that it is wrong. Certainly, doing this contradicts with Islamic teachings. They do that because the follow the bad habits that their ancestors used to do, and as they are greedy. The ruling on dividing inheritance properly is stated clearly in the Holy Qur’an. Allah says: “There is a share for men and a share for women from what is left by their parents and those nearest related, whether the property be small or large- al legal share.” An-Nisa’: 7
Stealing sisters’ portion is considered like dirty money and haram money. Those who gets that money are going to be punished in the Afterlife. Allah says: “They eat up only fire into their bellies, and they will be burnt in the blazing fire.” An-Nisa’: 10
Whoever prevents his sisters from getting their share is disobedient and sinful; therefore, they will get their punishment. The prophet ordered Muslims to treat their children fairly, and the mother should not force her daughters to waive their rights. The prophet said: “Fear Allah and treat your children fairly.”
