What is the ruling on the following issue? A father wrote all his possessions to his only daughter (before his death) so as to guard her from her only uncle (the father’s brother) whose behavior is not satisfying. Does the uncle have any legal right to inherit after the death of his brother?
Answer
Praise Be to Allah and Peace Be Upon His Messenger.
The father is not allowed to write all his possessions to his daughter with the intention of preventing other heirs (who has the legal right to inherit) from getting inheritance. If the father does not intend to prevent other heirs from getting their share, then he is not to blame. It is all about the father’s intention and aims. It is difficult to guess the intentions of the deceased father. I recommend that the uncle tries to fix the matter with his niece. Otherwise, he can raise an issue to the court.
