What is the ruling if the wife converts into Islam while the husband insists on remaining a non-Muslim? Can their marriage continue taking into account that he treats her well, or shall they break up?

Answer

Praise Be to Allah and Peace Be Upon His Messenger.

Once the wife converts into Islam and her husband does not, the marriage contract becomes invalid; they cannot stay with each other. She is ultimately divorced; however, she should wait for the three-month period; if he converts into Islam within this period, she returns to him as a wife; otherwise, she becomes legally divorced and cannot return to him. However, if he later converts into Islam, and they both want to get married, they can.

Regarding treating her well, this cannot be a substitute for him to becoming a Muslim.
