Is It Permissible to Accept a Share of Tips Distributed Among Restaurant Employees After Leaving the Job?
Answer
Praise be to Allah, and may peace and blessings be upon the Messenger of Allah, his family, and his Companions.
The woman who gave the money to the restaurant employees did so on the understanding that they were working there at the time of the distribution. This money constitutes a permissible gift to those whom she intended to receive it and to whom she willingly chose to give it.
Accordingly, if someone had left the restaurant job but was included among the employees receiving the money without the woman knowing that they were no longer employed there, it is not permissible for that person to accept their share. This is because her consent to give the money was conditional upon the recipient being an employee, and that condition no longer applies.
However, if she is informed of the person’s actual circumstances and subsequently gives her permission, or if she has granted the restaurant management general authorization to distribute the money to whomever they deem appropriate, then accepting the money is permissible, and there is no religious objection to doing so.
Therefore, it is necessary to ascertain the donor’s consent and discharge one’s responsibility by returning the allocated share to those for whom it was intended if explicit permission has not been established.
And Allah knows best.
